The duty of the land owner is maintained in proper condition of trees and shrubs growing on the possession.
All cutting and technical treatments of trees and shrubs, owner should be carried out on their own, on the condition that he knew the rules of the art of gardening.
If the owner haven’t got the appropriate qualifications should delegate the work of professionals.
In Poland, for the execution of cutting treatments permit is not required. If owner want remove the tree or shrub he should have a permit. Exceptions are areas entered in the register of monuments, where every action related to cutting and maintenance of green areas requires the permission of the Regional Conservator. Also the except of fruit trees and shrubs growing on private property and having less than 10 years, the owner can no permission to cut them.
The range of possible cutting treatments performed within the treetops growing in the green or wooded areas was legally restricted in art. 82 paragraph. 1 and the Nature Conservation Act (Journal of Laws of 2013. Poz.627, as amended).
